1.2. THE BUYER
The person whose name, surname, address, telephone and email details are recorded on www.viracasa.com when the order is placed.
By accepting this agreement, the BUYER acknowledges in advance that they will be under an obligation to pay the price of the ordered goods and any shipping cost, and that they have been informed of this.
ARTICLE 2 — SUBJECT
The subject of this agreement is to determine the rights and obligations of the parties, in accordance with Turkish Law No. 6502 on Consumer Protection and the Distance Contracts Regulation, regarding the sale and delivery of the product ordered electronically by the BUYER from the SELLER's website www.viracasa.com, whose characteristics and sale price are stated below.
ARTICLE 3 — THE GOODS AND PAYMENT DETAILS
The type, quantity, brand/model, colour, sale price (VAT included), payment method and delivery details of the product are as set out in the BUYER's order summary and order confirmation email. The prices listed and announced on the site are the sale prices. Announced prices and undertakings are valid until they are updated or changed.
ARTICLE 4 — GENERAL PROVISIONS
4.1. The BUYER declares and accepts that they have read and understood the preliminary information on the essential characteristics of the product, the sale price, the payment method and delivery, and that they have given the necessary confirmation electronically.
4.2. The product is delivered to the delivery address given by the BUYER, not exceeding the legal period of 30 (thirty) days following receipt of the order by the SELLER.
4.3. If the product is to be delivered to a person or organisation other than the BUYER, the SELLER cannot be held responsible if that person or organisation refuses the delivery.
4.4. The BUYER is obliged to inspect the product on delivery and, where a problem caused by shipping is visible (dents, breakage, torn packaging, etc.), to refuse the product and to have a report drawn up by the courier representative. Once a product has been accepted, the courier company's liability is deemed to have ended.
4.5. Delivery of the product requires that this agreement has been confirmed electronically and that the price has been paid by the BUYER's chosen payment method. If for any reason the price is not paid or is cancelled in the bank records, the SELLER is released from the obligation to deliver.
4.6. If, after delivery, the bank or financial institution does not pay the price to the SELLER because the BUYER's credit card has been used unlawfully or without authorisation by third parties through no fault of the BUYER, the BUYER is obliged to return the product to the SELLER within 3 (three) days. In that case the delivery costs are borne by the BUYER.
4.7. If it becomes clear that the product cannot be supplied, the SELLER informs the BUYER clearly and without delay and refunds all payments collected, including any delivery costs, within 14 (fourteen) days at the latest from the date of notification.
4.8. Where the product cannot be delivered on time because of force majeure (natural disaster, war, strike, epidemic, infrastructure and internet failures, delays caused by courier companies, etc.), the SELLER informs the BUYER. The BUYER may request cancellation of the order.
ARTICLE 5 — RIGHT OF WITHDRAWAL
5.1. The BUYER has the right to withdraw from the agreement within 14 (fourteen) days of the product being delivered to them or to the person/organisation at the address they gave, without giving any reason and without paying a penalty.
5.2. It is sufficient for notice of the use of the right of withdrawal to be sent to the SELLER in writing, or by email to info@viracasa.com, within that period.
5.3. Where the right of withdrawal is used, the product must be returned unused, complete and undamaged, together with its box, packaging and any standard accessories.
5.4. The SELLER refunds the total amount collected to the BUYER within 14 (fourteen) days at the latest from receipt of the withdrawal notice. The refund is made in a manner appropriate to the payment instrument used at purchase. For card payments, how long the amount takes to appear on the card depends on the bank concerned.
5.5. Where the right of withdrawal is used, the return shipping cost is borne by the SELLER; the return must be sent using the DHL return code provided by the SELLER. If the BUYER chooses a different courier, the shipping cost is borne by the BUYER.
ARTICLE 6 — GOODS EXEMPT FROM THE RIGHT OF WITHDRAWAL
Under Article 15 of the Distance Contracts Regulation, the right of withdrawal cannot be used for:
- products prepared to the BUYER's requests or personal needs, made to order, or personalised with a name or design,
- products whose protective elements such as packaging, tape, seal or wrapping have been opened after delivery and which cannot be returned for health or hygiene reasons,
- perishable products or products whose expiry date may pass,
- products which, after delivery, are mixed with other goods and by their nature cannot be separated.
Returns of products that have been used, broken or damaged, whose original packaging has been ruined, or which have lost their resaleable condition are not accepted.
ARTICLE 7 — DISPUTES AND COMPETENT AUTHORITY
For disputes arising from this agreement, the Consumer Arbitration Committees at the place of residence of the BUYER or the SELLER are competent within the monetary limits announced each year by the Turkish Ministry of Trade, and the Consumer Courts are competent for disputes above those limits. Applications may also be made through the Consumer Information System (TÜBİS) via e-Devlet.
ARTICLE 8 — ENTRY INTO FORCE
When the BUYER makes payment for an order placed through the site, they are deemed to have accepted all the terms of this agreement. The agreement enters into force on the date it is confirmed electronically by the BUYER.
